Terms of Service

These Terms of Service form a legally binding agreement between you and DUBPLATE SOCIETY (Australia, New South Wales) ("Dubplate Society", "we", "us", "our") and govern your access to and use of our website, apps and related services.
If you do not agree to these Terms, do not use the Service.
1. The Service
Dubplate Society is a digital platform where creators, artists, labels and rights-holders can upload, market and sell digital music releases including dubplates, plates, drops, dubpacks and similar digital goods. Buyers can purchase and download those digital goods when purchasing is available.
We may apply technical measures to protect content and transactions, including watermarking, unique identifiers, download controls and fraud prevention systems.
2. Eligibility and Accounts
You must be at least 18 years old to create an account, purchase content or sell content on the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
We may suspend, restrict or terminate accounts where reasonably necessary to protect the Service, other users, creators, or to comply with law.
3. Creator and Seller Terms
As a creator or seller, you may upload audio files, artwork, metadata, descriptions and other materials ("Creator Content"). You retain ownership of your Creator Content, subject to the licences needed to operate the Service.
You represent and warrant that you own, control or have all rights necessary to upload and sell the Creator Content, including rights in sound recordings, compositions, artwork, branding and metadata. Your Creator Content and listings must not infringe third-party rights or contain unlawful, hateful, harassing or doxxing content.
You grant Dubplate Society a worldwide, non-exclusive, royalty-free licence to host, store, cache, reproduce, process, encode, distribute, publicly display and make available your Creator Content for operating, improving, marketing and providing the Service. This includes generating previews, waveforms, thumbnails and uniquely watermarked or identified copies for buyers.
You are responsible for listing accuracy, including prices, descriptions and availability settings such as open, limited or exclusive releases.
4. Stripe Connect and Payouts
To sell on the Service you must connect a Stripe account through Stripe Connect and complete any identity, tax or onboarding steps required by Stripe. Payout timing and availability depend on Stripe, your account status, chargebacks, refunds required by law and other risk controls.
You are responsible for determining, collecting, reporting and paying any taxes that apply to your income or sales unless we explicitly state otherwise in writing.
5. Buyer Terms
When you purchase a digital item through the Service, you receive a personal, non-exclusive, non-transferable, non-sublicensable licence to download and use that digital item for your own personal use unless the creator's listing states otherwise.
You must not redistribute, resell, publicly share, upload, stream, broadcast or otherwise make purchased files available to others without the rights-holder's explicit permission.
Purchased files may contain forensic watermarks or unique identifiers associated with the transaction. Download access may use time-limited or single-use links or tokens.
6. Final-Sale Policy and Exceptional Remedies
Digital audio purchases are final. Dubplate Society does not provide refunds for change of mind, accidental purchases, failure to review disclosed product information or compatibility requirements, or because a customer no longer wants the purchased audio. Nothing in this policy excludes rights or remedies that cannot legally be excluded.
An authorised administrator may approve an exceptional remedy for a duplicate charge, confirmed payment-system error, verified platform failure, confirmed fraud or account compromise, a remedy required by applicable law, or another exceptional case approved by Dubplate Society. Download status alone does not create a right to a refund.
7. Fees, Payments and Chargebacks
Payments are processed by Stripe. We do not store your full payment card details. Unless otherwise stated on the Service at the time of sale, the standard platform fee is 10% of the transaction amount, excluding any third-party fees, taxes or adjustments where applicable.
If a buyer initiates a dispute or chargeback, we may place holds, reverse transfers, deduct amounts from future payouts or require additional information. You agree to cooperate with reasonable requests relating to disputes and chargebacks.
8. Leak Reporting and Enforcement Tools
We may allow users and the public to submit suspected leak reports for review and forensic analysis. Reports, matches and analytics are provided for informational purposes and do not constitute legal advice or a guarantee of admissible evidence.
9. Copyright and Takedowns
If you believe content on the Service infringes your copyright or other rights, contact us at support@dubplatesociety.com with sufficient information for us to investigate, such as your contact details, identification of the work, the allegedly infringing material and supporting information.
10. Prohibited Conduct
You must not upload or sell content you do not have rights to, upload unlawful or hateful content, harass or threaten others, publish personal information without consent, circumvent security or watermarking controls, scrape or probe the Service, or use the Service for fraud, money laundering or illegal activity.
11. Third-Party Services
The Service may integrate with third-party services including Stripe, analytics providers, email providers and hosting or storage providers. We are not responsible for third-party services and your use of them may be governed by their own terms and policies.
12. Availability, Changes and Termination
The Service may change over time and may be unavailable from time to time. We may update these Terms and provide notice where reasonable. We may suspend or terminate access if we reasonably believe you have violated these Terms or where needed to protect the Service, users, creators or comply with law.
13. Disclaimer and Liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We make no warranties that the Service will be uninterrupted, secure, error-free, or that downloads will always be available. Creators are solely responsible for their listings and Creator Content.
To the maximum extent permitted by law, Dubplate Society will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data, goodwill or business interruption. This does not exclude liability that cannot be excluded under law.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
